B Informationen zum Fernabsatzvertrag Ein Kaufvertrag kommt zwischen dem Kunden und der Firma Wunderlich GmbH, Kranzweiherweg 12, 53489 Sinzig, vertreten durch die Geschäftsführer Erich Wunderlich und Alexander de la Motte, zustande. Der geschäftliche Zweck des Vertrages ist auf den Verkauf unserer angeboten Waren ausgerichtet und kommt durch eine Bestellung per Post, Telefax, Telefon oder Internet und durch anschließende Annahme der Bestellung durch unser Unternehmen in Form einer schriftlichen Auftragsbestätigung oder das Zusenden der bestellten Ware zustande.
C Lieferbedingungen Die Lieferung durch uns erfolgt unter dem Vorbehalt, dass wir selbst richtig und rechtzeitig beliefert werden und die fehlende Verfügbarkeit nicht zu vertreten haben. Bei telefonischer Bestellübermittlung übernehmen wir keine Haftung für eventuelle Übermittlungsfehler. Alle unsere Preise gelten ab unserem Lager in EURO inklusive der zur Zeit gültigen Mehrwertsteuer. Pro Lieferung innerhalb Deutschlands berechnen wir zusätzlich einen Versandkostenanteil von 6,90 EUR. Bei Nachnahme kommt die Nachnahmegebühr hinzu. Für folgende Länder gilt eine Versandkostenpauschale von 14,90 Euro: Niederlande, Belgien, Luxemburg, Österreich, Schweiz. Für folgende Länder gilt eine Versandkostenpauschale von 18,90 Euro: Schweden, Finnland, Polen, Slowenien, Schweiz, Lichtenstein. Für alle anderen Länder werden die tatsächlichen Kosten in Rechnung gestellt. Die Ware ist sofort nach Empfang durch den Kunden oder seinen Beauftragten auf Transportschäden zu untersuchen. Festgestellte Transportschäden sind unverzüglich schriftlich anzuzeigen. Verpackungsschäden muss sich der Kunde bei Annahme der Ware von dem Transportunternehmen schriftlich bestätigen lassen. Für die Schweiz und Nicht-EG Länder gilt: Sie müssen bei uns keine Mehrwertsteuer bezahlen. Sie können die angegebenen Preise wie folgt umrechnen: Bestellwert dividiert durch 1,19 (je nach zur Zeit gültiger Mehrwertsteuer), zzgl. Versandkostenanteil. Rücksendungen aus dem Ausland müssen vorab mit uns abgeklärt werden und uns ohne Zollformalitäten erreichen. Zu bearbeitende Ware müssen ohne Wertangabe gesendet werden.

E Widerrufsrecht
Für alle von uns per Versand gelieferten Waren gewähren wir Verbrauchern ein 14-tägiges Widerrufsrecht. Sie können innerhalb von zwei Wochen ab Erhalt der Ware und einer Widerrufsbelehrung in Textform ohne Angabe von Gründen per Brief, Fax oder email Ihr Rücknahmeverlangen erklären. Der Widerruf bedarf keiner Begründung. Auch die Rücksendung der Sache innerhalb zweier Wochen beinhaltet den Widerruf.
Im Falle des Widerrufs ist der Käufer zur Rücksendung der Ware verpflichtet. Bei Rückgabe von Waren aus einer Lieferung mit einem Bestellwert von insgesamt bis zu 40,00 EUR trägt der Käufer die Kosten der Rücksendung, ansonsten Firma Wunderlich. Innerhalb Deutschlands kann die Rücksendung der Ware für Sie kostenfrei über eine Ihnen von uns zugesandte Freeway-Paketmarke oder gegebenenfalls über einen von uns organisierten Rückholauftrag erfolgen.
Im Falle eines wirksamen Widerrufs sind die beiderseits empfangenen Leistungen zurückzugewähren und gegebenenfalls gezogene Nutzungen (z.B. Gebrauchsvorteile) herauszugeben.
Bitte beachten Sie, dass bei Inanspruchnahme Ihres Rückgaberechts der Firma Wunderlich die Wertminderung zu ersetzen ist, soweit Sie diese infolge einer Verschlechterung, Beschädigung oder deren Verlust zu vertreten haben.
F Gewährleistung/Garantie Es gelten die gesetzlichen Gewährleistungsbestimmungen. Gewähren wir besondere Garantien, lässt dies Ihre gesetzlichen Gewährleistungsansprüche unberührt.
G Haftung Wir schließen unsere Haftung für leicht fahrlässige Pflichtverletzungen aus, sofern diese keine vertragswesentlichen Pflichten, Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit betreffen oder Ansprüche nach dem Produkthaftungsgesetz berührt sind. Gleiches gilt für Pflichtverletzungen unserer Erfüllungsgehilfen und Vertretungsorgane.
H Eigentumsvorbehalt Die Ware bleibt bis zur vollständigen Bezahlung Eigentum der Firma Wunderlich GmbH. Geraten Sie mit der Zahlung länger als 14 Tage in Verzug, haben wir das Recht, vom Vertrag zurückzutreten und die Ware zurückzufordern.
I Schlussbestimmungen
Es gilt das Recht der Bundesrepublik Deutschland. Die Anwendung des UN-Übereinkommens über Verträge über den internationalen Warenkauf vom 11.04.1988 ist ausgeschlossen.
Ausschließlicher Gerichtsstand ist unser Geschäftssitz, soweit der Kunde ein Kaufmann im Sinne des Handelsgesetzbuches oder eine Körperschaft des öffentlichen Rechts ist. Gleiches gilt, sofern der Kunde keinen allgemeinen Gerichtsstand im Inland hat oder sein Wohnsitz zum Zeitpunkt der Klageerhebung nicht bekannt ist.
Sollten einzelne Bestimmungen dieses Vertrages unwirksam sein oder den gesetzlichen Regelungen widersprechen, so wird hierdurch der Vertrag im übrigen nicht berührt.

A General Our catalogue only provides information that is non-binding and serves as guidance. All offers are non-binding and subject to amendment. The company Wunderlich retains the right to alter, supplement or delete the range of goods on offer in part or in whole without any specific announcement. The same will apply to the articles on display online at www.wunderlich.de.
B Information about Remote Sales Contract A Purchase Order materializes between the Customer and the company Wunderlich GmbH, Kranzweiherweg 12, 53489 Sinzig, represented by its Managing Directors Erich Wunderlich and Alexander de la Motte. The business aim of the Contract is to sell our goods on offer; it materializes through an order placed by post, telefax, telephone or over the Internet and by the subsequent acceptance of the order by our company in the form of a written Order Conformation or the despatch of the goods ordered.
C Terms of Delivery We effect delivery subject to the proviso that we ourselves receive supplies accurately and on time and are not responsible for any lack in availability. When orders are placed over the telephone, we will not be liable for any transmission errors. All our prices are as from our warehouse in EUR and include the currently valid Value Added Tax. For each delivery inside Germany we also make a charge for despatch to the amount of 6.90 EUR. When despatch is by cash-on-delivery, the COD fee must also be added. For the following countries a despatch fee of 14.90 EUR is charged: Netherlands, Belgium, Luxemburg, Austria, and Switzerland. For the following countries a despatch fee of 18.90 EUR is charged: Sweden, Finland, Poland, Slovenia, Switzerland, Liechtenstein. For all other countries, the actual costs are billed. The Customer or an authorized party thereof will check the goods immediately upon arrival for any transportation damage. Written notification of any transportation damages identified must be notified immediately in written form. Where the packaging is damaged, the Customer will have this confirmed in written form by the transport company when accepting the goods. For Switzerland and non-EU countries: there is no need to pay us VAT. In this case, the prices can be calculated as follows: the value ordered divided by 1.19 (depending on the percentage of VAT charged at the time) plus the charges for despatch. Return consignments from other countries must first be clarified with us and reach us without any customs formalities. Goods to be processed must be sent without giving details of the value.
D Terms of Payment You may effect payment as follows:
Direct debit mandate, although only for a written order and only with a German banking status
Cash-on-delivery only inside Germany; you will pay the COD charge.

E Right of Revocation
For all goods despatched by us, we grant consumers a 14-day right to withdraw from the contract. Within two weeks as from receiving the goods and information about your right of revocation, you may declare your intention to return the goods, without giving your reasons, by letter, fax or e-mail. You need not substantiate your revocation. The simple return of the article within two weeks constitutes a revocation.
In the event of revocation, the Purchaser undertakes to return the goods. When goods are returned from a consignment with an order value up to 40.00 EUR, the Purchaser will bear the costs of return, otherwise the company Wunderlich will bear the costs. Inside Germany, the return of goods can be free of charge if you use the free-way parcel stamp we send you or, where applicable, by means of a return order that we organize.
In the event of a valid revocation of contract, the services received by both Contracting Parties will be returned and where applicable, any benefits derived surrendered (e.g. compensation for use).
Please note that in exercising your right of return to the company Wunderlich, the loss in value will be compensated, where you are responsible for this as a result of deterioration, damage or loss.
F Warranty/Guarantee The provisions of the law governing guarantees will apply. Should we grant specific guarantees, your own rights to guarantee by law will not be affected hereby.
G Liability We rule out any liability on our part for infringements of duty that are slightly negligent, providing these relate to no major obligations of the Contract, damages incurred from injury to life or limb or do not relate to claims filed under the Product Liability Act. The same will apply to any infringement of duty on the part of our vicarious agents and representative organs.
H Retention of Title Until fully paid for, the goods will remain the property of the company Wunderlich GmbH. Should you default in payment in excess of 14 (fourteen) days, we will be entitled to withdraw from the Contract and to call for the return of the goods.
I Concluding Provisions
The law of the Federal Republic of Germany will apply. The United Nations Convention on Contracts for the International Sale of Goods of 11.04.1988 will be ruled out.
Exclusive place of jurisdiction will be our registered seat of business where the Customer is a businessperson as defined in the Commercial Code or a public corporation. The same will apply when the Customer has no general place of jurisdiction inside the country or the Customer’s place of residence is unknown at the time action is filed.
Should single provisions of the present Contract be invalid or conflict with regulations of the law, the Contract will not in other respects be affected hereby.
